Sushmaaa Travels Private Limited – Cab & Bus Rental Service Agreement
Role of Sushmaaa Travels Private Limited
  • Technology Platform: Sushmaaa Travels Private Limited acts as a technology platform that connects travelers with various vehicle operators for cab and bus rentals. The company does not own or operate the vehicles and only facilitates the booking process through its website and customer service channels.
  • Booking Voucher: The booking voucher issued by Sushmaaa Travels is based on details provided by the vehicle operators. This voucher serves as confirmation of the booking but does not constitute a guarantee regarding service quality or vehicle condition.
  • Service Fulfillment: All bookings are fulfilled by the respective vehicle operators, who are responsible for the execution of services such as driving, vehicle maintenance, and route management.
  • Information Accuracy: Sushmaaa Travels makes efforts to ensure the accuracy of the information on the platform but does not guarantee the correctness of details such as amenities, route schedules, vehicle types, or services provided by the vehicle operators. Any discrepancies must be addressed directly with the vehicle operator.
2. Limitation of Liability

Sushmaaa Travels Private Limited will not be held liable for the following:

  • Timeliness of Service: The company does not guarantee the timely departure or arrival of any vehicle.
  • Operator Conduct: Any issue related to the behavior of the vehicle operator’s staff, including drivers, is outside the responsibility of Sushmaaa Travels.
  • Vehicle Condition: The company does not assume responsibility for the condition of the vehicle, and users should report any issues directly to the vehicle operator.
  • Trip Cancellations: If the vehicle operator cancels the service, Sushmaaa Travels will not be liable for any inconvenience caused.
  • Loss or Damage to Baggage: Any loss or damage to user property, including luggage or personal belongings, is not the responsibility of Sushmaaa Travels.
  • Use of Separate Transport: If a separate vehicle is used for pickup or drop-off, any delays or issues related to this are not covered by Sushmaaa Travels.
  • Breakdowns or Delays: The company is not responsible for vehicle breakdowns or any delays that occur during the trip.
  • Legal Compliance: Sushmaaa Travels is not responsible for ensuring the vehicle operator’s licenses, permits, or other regulatory compliance matters.
3. User Responsibilities
  • Pre-Trip Communication: It is the user’s responsibility to contact the vehicle operator prior to the trip for confirmation of the boarding point, pickup time, and any specific requests.
  • Document Verification: Users must present a valid government-issued photo ID along with the booking voucher when boarding the vehicle.
  • Onboard Behavior: Passengers are expected to maintain appropriate behavior and follow any instructions provided by the driver or operator during the trip. Violent or disruptive behavior may result in termination of the journey without any refund.
  • Compliance with Laws: Users are expected to follow all local laws and regulations while traveling, including respecting no-smoking and no-alcohol policies on board.
4. Payment Terms
  • Full Payment: Payment in full is required at the time of booking, covering the base fare, taxes, and any applicable service fees.
  • Partial Payment: A partial payment may be required upfront, with the balance due within the specified period before the trip. Failure to make the full payment may result in cancellation of the booking.
  • Pay at Boarding Point: In certain cases, users may pay a portion upfront, with the remaining balance due directly to the vehicle operator when boarding.
  • Additional Costs: Any extra charges such as toll fees, parking fees, entry fees, or other government taxes are to be paid directly to the vehicle operator by the user.
  • Driver Tips: A “driver bata” or tip may be applicable at the discretion of the user, and should be paid directly to the driver at the end of the journey.
  • Insurance: Optional travel insurance may be offered at the time of booking. Users are advised that any claims or concerns related to the insurance policy must be addressed directly with the insurance provider or vehicle owner, not Sushmaaa Travels Private Limited
5. Cancellation & Rescheduling Policy
  • Cancellation (7+ Days Before Trip): 100% refund of the advance booking amount will be made.
  • Cancellation (2-7 Days Before Trip): 50% cancellation charge will be levied on the total fare.
  • Cancellation (Within 24 Hours of Trip): 100% cancellation charge will be applicable on the total fare.
  • Rescheduling: Minor rescheduling (within 1-2 hours) may be done at no extra charge. Extended reschedules or changes to trip dates may incur an hourly charge, depending on the operator’s terms.
  • Exclusions: All toll charges, parking fees, and entry fees are not included in the quoted price and are to be borne by the user.
6. Safety and Onboard Policies
  • Safety Features: All vehicles are equipped with safety features such as fire extinguishers, first aid kits, emergency exits, ABS (Anti-lock Braking System), and EBD (Electronic Brakeforce Distribution).
  • Vehicle Maintenance: Vehicle operators are expected to maintain their fleet in good condition. Sushmaaa Travels does not guarantee the condition of the vehicles, but users are encouraged to report any concerns to the vehicle operator immediately.
  • Alcohol and Smoking: Both smoking and consumption of alcohol inside the vehicle are strictly prohibited. Any violation of this policy may result in the termination of the trip without refund.
  • Emergency Protocols: In case of a breakdown or emergency, users must contact the vehicle operator immediately. Sushmaaa Travels is not responsible for providing alternate transportation in such cases.
7. Force Majeure Clause

Sushmaaa Travels will not be held liable for any delays, cancellations, or failures to fulfill service agreements due to factors beyond its control, including but not limited to:

  • Natural Disasters: Earthquakes, floods, or other natural calamities.
  • Government Policies: Any sudden legal, political, or regulatory changes affecting the travel industry.
  • Transport Strikes: Labor strikes affecting public or private transport.
8. Dispute Resolution
  • Arbitration: In case of any disputes related to this agreement, both parties agree to resolve them through arbitration as per the laws of Thane, Maharashtra, India
  • Jurisdiction: The exclusive jurisdiction for resolving any legal disputes shall be Mira Bhayandar, Thane India.
9. Miscellaneous Terms
  • Modifications to Terms: Sushmaaa Travels reserves the right to modify or update the terms and conditions at any time. Users will be notified of changes through the website or via email.
  • User Feedback: Feedback from users is important to improve services. Any complaints or suggestions should be directed to the customer service team of Sushmaaa Travels for further resolution.
